RE: HIPAA privacy rules Federal register Vol. 67, No. 157
The materials we are providing you today relate to Case Management Works' recognition of the physician's responsibilities under the new HIPAA privacy act.
Based on research of the Federal Register/Volume 67, Number 157 it has been judged that workers' compensation insurance is not a "health plan" and further that "it is excluded from the HIPAA Privacy Regulation". It further "clarifies in the preamble that the minimum necessary standard is not intended to impede the disclosure necessary for workers' compensation programs."
Case Management Works and its Medical Case Managers are agents/consultants of the insurance carriers. As agents we are therefore excluded from this HIPAA regulation as it pertains to the workers' compensation case on which we provide services.
Case Management Works assures you that even though we are excluded from HIPAA compliance, we do maintain the highest standards for the nursing profession, as well as the standards for certified case managers (CCM).
